This section sets out the Terms and Conditions by which “Can You Catch the Killer?” agrees to provide products and services to you.
Additional terms to these standard terms and conditions may be included in your specific invoice pack upon booking. Please read your contract upon booking for specific terms and conditions as they pertain to your event.
Effective date: November 17th , 2010
1.1 This section sets out the Terms and Conditions by which “Can You Catch the Killer?” agrees to provide products and services to you.
1.2 When you book or purchase any product or service from us, you are signifying your agreement to these Terms and Conditions. These are sent to you via email as part of the booking service and are available in hard copy upon request. It is your responsibility to familiarise yourself with them before you book or purchase any product or service from us.
1.3 We reserve the right to modify, cancel or append to these Terms and Conditions without notice. The current Terms and Conditions will always be sent to persons upon entering the booking process. On renewal of any “Can You Catch the Killer?”product or service, the most recent Terms and Conditions shall apply.
1.4 “Can You Catch the Killer?” is based in Falkirk, Scotland.
2.1 “Can You Catch the Killer?” refers to all aspects of “Can You Catch the Killer?” (including “Can You Catch the Killer?”, Productions, Shows, Education & Outreach and Event(s) unless otherwise stated.
2.2 “Can You Catch the Killer?”, “we”, ”us”, or “our” refers to “Can You Catch the Killer?” and any of its directors, officers, employees, managers, volunteers, subcontractors, agents.
2.3 “Show(s)”, refers to the individual and self contained show(s) offered by “Can You Catch the Killer?”.
2.4 “Inform”, “Notify”, “Communicate” and “Contact” are the processes by which we exchange information and enter into contracts regarding our products or services.
2.5 “Booking” refers to the process of entering into and the agreement made for “Can You Catch the Killer?” to provide a Show and/or Event.
2.6 “Invoice Pack” is the form that we send to you for completion prior to confirming any Booking.
2.7 “You” or “The Client”, refers to a person or organisation buying products or services from us and is accepting these conditions not only for itself but as an authorised agent of the Guests or Party.
2.8 “Guest(s)”, is any person(s) attending the event or show provided by us.
2.9 “Party”, is any person(s) attending the event or show provided by us.
2.10 “Event(s)”, refers to individual and self contained event(s) offered by “Can You Catch the Killer?”.
3.1 General Disclaimer: For the avoidance of doubt, all our products and services are provided on an “as is” basis and save as expressly stated herein without representations, conditions, warranties or other terms of any kind, either express or implied, including, but not limited to, events, non-infringement or title but excluding the implied warranties of satisfactory quality and fitness for a particular purpose.
3.2 Cancellations & Venue Changes.
3.2.1 We reserve the right to cancel any show/event or other service at any time up to and including the date the event starts. Should this occur we will endeavour to give you at least five days’ notice but cannot guarantee this. We will attempt to offer you a viable alternative or refund of any fee paid. We cannot be held liable for any cancellation costs (hotel, travel etc) you may incur should an event or show be cancelled.
3.2.2 We reserve the right to cancel any show/event up to and including the start time of said show/event if we feel that any Client, Guest or Party behave in a manner we deemed inappropriate, behave dangerously or act in a manner so as to disrupt the event.
3.2.3 Occasionally it is necessary to change the venue of our shows or events. We aim to give five days’ notice where this occurs and we will endeavour to ensure that the alternative venue is within a reasonable travelling distance from the original but we cannot guarantee this.
3.3 Health and Safety: Our shows and events are live performance(s) and may incorporate but are not limited to the following: loud bangs or explosions, weapons, violence, menace, elements of horror, lighting effects (strobe) etc. As a guest you will be in close proximity to the performance and shall abide by and comply with any request or order made by or on behalf of “Can You Catch the Killer?” on the grounds of safety, whether it be the safety of the Client, Guest or some other person.
3.3.1 The Client and every Guest agrees that the opinion of “Can You Catch the Killer?” is final in regards to any matters appertaining to safety and the Client and every Guest agrees to abide by any such opinion howsoever expressed.
3.3.2 “Can You Catch the Killer?” accepts no liability for loss, injury or damage of any nature whatsoever, whether direct or consequential , arising out of provision of Event(s), save as provided under the Unfair Contract Terms Act 1977.
3.4 Personal Property: “Can You Catch the Killer?” accepts no responsibility in respect of any loss or damage to any property of the Client or any Guest.
3.5 Other Losses: We do not accept responsibility for any loss or expense due to circumstances beyond our control, including but not limited to, delays in public transport, weather, quarantine, sickness, bereavement, strikes or other industrial action, terrorism, fire and riot.
3.5.1 Without prejudice to the other terms of this agreement, in no event (including our own negligence) will we be liable for any:
3.6 Third Parties: A person who is not party to these Terms and Conditions or any agreement or document incorporating these Terms and Conditions shall have no right under the Contracts (Third Party Rights)(Scotland) Act 2017 to enforce any of its terms.
3.7 Overselling: We may agree a maximum number of audience members with you for your event and provide a price accordingly. If there are a greater number of audience members than agreed you will automatically be charged an additional 100% of the price quoted for your event.
3.7.2 should you wish to increase the maximum number of audience members permitted please contact us at least two weeks prior to the performance.
From time to time, photographs, film, video or audio recordings may be made during “Can You Catch the Killer?” events for publicity, promotional or broadcast purposes. Please inform us before any such event if you do not wish to appear or be identified in any such material.
5.1 These Terms and Conditions and any invoice pack you have recieved constitutes the entire agreement between you and us in connection with your Booking, purchase or use of any of our products and events superseding any prior agreements between you and us.
5.2 You agree that you have entered into these Terms and Conditions without reliance on any representation, warranty or undertaking by us, which is not set out expressly in these Terms and Conditions.
You must provide us with all required details in order for us to confirm any Show or Event
7.1 The cost of “Can You Catch the Killer?” Events and Shows and valid methods of payment will be given to the Client upon request from “Can You Catch the Killer?” . We reserve the right to alter prices at any time without prior notice. We will not pursue for additional costs to Events or Shows Booked at the previously agreed rate. We will not refund any additional costs made if Event or Show prices are reduced after booking.
7.2 Deposits are required to be paid directly to “Can You Catch the Killer?” before any Booking can be confirmed.
7.3 Full payment for each Event must be received by “Can You Catch the Killer?” a minimum of 14 days prior to the Event date, or by the agreed deadline if a Show or Event is Booked within a 14 day period.
7.4 Payment of a deposit constitutes a binding indication of full agreement to these terms and conditions.
7.5 Payments can be made by bank transfer or cheque. We can also accept payments by credit or debit card via PayPal on request. Payments through PayPal will be subject to an additional charge of 3.5% of your total payment – this charge is levied by PayPal, not by Can You Catch The Killer, and cannot be waived by Can You Catch The Killer.
8.1 All deposits, however paid, are non-refundable.
8.2 In the event of non-payment in full after the minimum 14 day period we reserve the right to cancel the Event, retain any deposit and offer the Event to another Client.
8.3 In the event of full payment being received and for any reason you cancel the Event within 14 days of the Event date, you will receive no refund.
8.4 Should you cancel your booking and allow a minimum of 28 days’ notice prior to the Event you will receive a full refund except for your non-refundable deposit
8.5 If for any reason you cancel a show that has been booked within a 14 day period and have paid a deposit you will receive no refund and will be liable to pay 100% of the agreed price.
8.6 If an Event is cancelled due to any Client, Guest or Party behaving in a manner we deem inappropriate, dangerous or so as to disrupt the event, no refund will be given to that Client, Guest or Party
8.7 If a special price is agreed upon based on a bulk buy of a certain number of events, and you cancel events at any point which results in you having fewer events booked in total than the required amount agreed for the bulk buy, you forfeit all bulk buy discounts and will be charged full price for the remaining events.
8.7.1 If any events have already taken place at the discounted rate the amount discounted will be added on to the fee for future events or invoiced for separately.
8.8 Can You Catch The Killer will not travel if Met office guidelines recommend against it, or if we believe travelling to be dangerous. This generally occurs during amber or red weather warnings, though also occasionally during yellow weather warnings.
8.8.1 We reserve the right to cancel due to weather conditions at any point up to and including the day of your performance.
8.8.2 Should we have to cancel due to unsafe travel conditions you will receive a full refund minus your non-refundable deposit provided we have not yet left.
8.8.3 If we begin travelling and find ourselves unable to reach your venue due to weather or the effects of weather you will be liable to pay a cancellation fee of 75% of the total agreed price. We recommend contacting us immediately should you become aware of any weather conditions that may impact our ability to reach your venue.
8.8.4 Should we reach your venue but adverse weather conditions leave us no safe means by which to travel back to our base of operations we may hold you liable for any accommodation or subsistence costs we incur.
8.8.5 Whether or not the travel conditions constitute being considered unsafe will be the sole decision of Can You Catch The Killer.
8.9 Can You Catch The Killer will not allow an actor to perform if they are showing signs of contagious illness – such as Covid 19 symptoms – which may be harmful to you, your guests, or our cast.
8.9.1 If an actor shows symptoms of such a potentially harmful contagious illness with enough time before your event to undergo tests (such as a PCR test for example) and those tests come back negative, ruling out the possibility of the illness being harmful, the actor may still perform with your permission.
8.9.2 Should the actor develop symptoms of a potentially harmful contagious illness with too little time to be tested your event will be cancelled for your safety and for ours.
8.9.3 Should we cancel your event due to an actor developing symptoms of a potentially harmful contagious illness you will receive a full refund minus your non-refundable deposit.
8.9.4 If you or your guests show signs of a potentially harmful contagious illness and cannot provide evidence of negative tests we reserve the right to cancel the event immediately, without refund, for the safety of our performers and your guests.
8.9.5 Should guidelines or lockdowns owing to a potentially harmful contagious illness prevent your event from going ahead you will receive a full refund minus your non-refundable deposit.
8.9.6 What constitutes the symptoms of a potentially harmful contagious illness will be determined by, and the sole decision of, Can You Catch The Killer (informed by any existing government or medical guidelines that may be in operation)
8.10 Any delay of the performance which results in the show beginning one hour or more later than the expected start time, and which is not the fault of Can You Catch The Killer, will result in an additional fee of £100 payable within a week of the performance’s end.
9.1 We reserve the right to alter, vary, omit or substitute any part or parts of any Event or Show provided by us and described in any promotional or other materials published by us or on our behalf.
9.2 In the event of any change in any content as described by us, we will have no liability to refund any part of any fee or deposit paid.
10.1 If your event is being sold to the public you must name the provider as “Can You Catch the Killer Murder Mystery events”. No variation on this name is permitted without the prior written consent of “Can You Catch the Killer?”. Shows provided by “Can You Catch the Killer?” must be marketed under their official titles and no variation of these titles is permitted without the prior written consent of “Can You Catch the Killer?”
10.2 If you are marketing this event to the public full copy for each Show will be provided by “Can You Catch the Killer?”. This copy must be presented on marketing in full and unchanged unless you gain the express written consent of “Can You Catch the Killer?”
10.3 Credit must be given on marketing material to both “Can You Catch the Killer?” and any photographer’s images that may be used as provided by “Can You Catch the Killer?”
10.4 Only official promotional images as provided by “Can You Catch the Killer?” may be used in the marketing of a “Can You Catch the Killer?” event unless prior explicit written consent as been obtained
10.5 “Can You Catch the Killer?” and it’s logos are registered trademarks and may not be altered in any way.
10.6 The unique format of a “Can You Catch the Killer?” event, the scripts, copy, blurbs and all promotional material or written material provided by “Can You Catch the Killer?” are copyright properties of “Can You Catch the Killer?” and cannot be replicated or reused in whole or in part without the prior explicit written consent of “Can You Catch the Killer?”
11.1 We may wish to contact you by post, telephone, email or fax. Notifications sent to you by post will be deemed received by you within 2 working days. Any other notifications will be deemed received by you within 1 working day.
11.2 It is your responsibility to ensure we have current contact details for you.
12.1 Should a venue be required for an event the booking of that venue and any associated costs are the responsibilty of the client. Any additional costs related to this, such as heating or electricity, is also your responsibility.
12.2 If the event is part of a Murder Mystery Meal the provision of the meal is your responsibility.
12.3 If you are booking “Can You Catch the Killer?” for an event that will be open to the public the provision of box office facilities, online sales, box office staff and front of house staff is your responsibility. You will also need to comply with the latest Health and Safety at Work Act and the current Health and Safety Legislation as you are admitting the public to the premises. The venue is responsible for the safety of all its paid employees and voluntary helpers who are involved with our event. The venue is responsible for ensuring the building is in safe condition and that property is cared for.
12.4 If you are booking “Can You Catch the Killer?” for an event that will be open to the public the cost of marketing the event in the form of posters, flyers or any other form of marketing costs is your responsibility. If you wish for posters or flyers or other forms of physcial marketing materials to be provided by “Can You Catch the Killer?” please discuss this with us upon booking.
12.5 If you are booking “Can You Catch the Killer?” for an event that will be open to the public you are responsible for all safety requirements of the venue. Fire safety, electrical and heating equipment must be kept in good working order, a first aid box must be provided and instructions for emergency procedures must be displayed.
12.6 It is your responsibility in all cases to ensure the venue has relevant licenses if required for our visit. Contact your local authority for further information.
12.7 It is your responsibility to provide an adequate, secure, and fit for purpose room in which the performers can change and safely and securely store their belongings. In the absence of a secure and appropriate room we reserve the right to cancel your performance with no refund.
13.1 Any failure of these Terms and Conditions if found by a court of competent jurisdiction to be invalid or unenforceable, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision and that other provisions remain in full force and effect.

For productions, events, shows, outreach and /or corporate activities: additional and/or changes to these terms and conditions will be negotiated, if applicable, on a client by client basis and will be confirmed by “Can You Catch the Killer?” in writing.
